General

Welcome to Listing BEAST, operated by Brendan Bartic Real Estate Coaching LLC (“Company,” “we,” “our,” or “us”). By enrolling in, accessing, or participating in the Listing BEAST program (the “Program”), you agree to the following Terms & Conditions (“Terms”). These Terms apply in conjunction with our Privacy Policy. If you do not agree, you must not access or participate in the Program.

Program Description

The Program is a proprietary coaching and training platform designed to help real estate agents build a scalable listing-based business. Participation includes access to a private online portal containing video modules, templates, and training resources; weekly group coaching calls; and membership in a private community for peer-to-peer support and accountability. The Company may update, enhance, or modify Program content at its discretion without notice.

License and Access

Upon enrollment, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Program materials for your personal business use only. All usernames, passwords, and access credentials are for individual use and may not be shared with third parties. Any unauthorized use, copying, distribution, or resale of Program materials constitutes a breach of these Terms and will result in immediate termination of your access without refund, and may subject you to legal action.

The Company reserves the right to limit, suspend, or terminate your participation in the program, without a refund, if:

• You disrupt or hinder other members' ability to engage with the program.

• You fail to follow program guidelines or violate community standards.

• Your actions negatively impact the learning experience of other participants or instructors.

Intellectual Property

All materials provided in the Program, including but not limited to videos, scripts, templates, strategies, playbooks, and training resources, are and remain the sole intellectual property of the Company. You agree not to copy, reproduce, record, distribute, sell, sublicense, modify, create derivative works, or otherwise exploit any Program content without express written permission. Your participation in the Program does not grant you any ownership rights in the Company’s intellectual property. 

Usernames and passwords for the program may not be shared with third parties. Any unauthorized use, reproduction, or distribution of program materials will result in immediate termination of your enrollment without a refund. The information contained in the program material is strictly for educational purposes. Therefore, if you wish to apply ideas contained in this material, you are taking full responsibility for your actions.

Confidentiality

In the course of your participation, you may receive confidential or proprietary information belonging to the Company or other participants. You agree to keep such information strictly confidential and not to disclose, share, or use it for any purpose other than participation in the Program. Confidential Information includes business strategies, trade secrets, personal experiences, and discussions occurring in Program sessions or communities. Unauthorized disclosure of Confidential Information will result in immediate termination of your access and may lead to legal enforcement.

Community Standards
You agree to participate respectfully in all Program communities, calls, and forums. You will not harass, disrupt, or interfere with the participation of others; post unlawful, defamatory, or offensive content; impersonate any person or entity; solicit or advertise without permission; or use Program communities for commercial gain. The Company reserves the right to moderate, remove content, or revoke access at its sole discretion.

By accessing and participating in Listing BEAST, you agree to uphold community standards and adhere to the following conditions:
 

• Do not restrict or inhibit any other user from using and enjoying the Site.

• Do not impersonate any person or entity or misrepresent your affiliation.

• Do not interfere with or disrupt servers or networks.

• Do not instigate or encourage others to commit illegal activities.

• Do not gain unauthorized access to the Site or its features.

• Do not post or transmit any unlawful, threatening, or offensive content.

• Do not exploit information, software, or materials for commercial purposes.

• Do not advertise or solicit without written approval.

• Do not gather user information for marketing.

Public Forums & Moderation

Brendan Bartic Real Estate Coaching and Listing BEAST may host Community events, chats, and forums. Users failing to comply may be expelled. Posts made by users do not reflect the views of the Company. The Company disclaims responsibility for third-party content and reserves the right to moderate as needed.

Content Monitoring & Enforcement

The company may alter, edit, refuse to post, or remove content for any reason and may disclose such materials if necessary to comply with laws, regulations, legal processes, or governmental requests.

Recording Consent

Program calls, workshops, and community sessions may be audio- and video-recorded. By participating, you consent to recording and to the Company’s use of recordings for internal training, quality assurance, and Program materials. If you do not wish to be recorded, do not speak or appear on camera and use written chat only, or refrain from attending live sessions and view recordings instead.

Third-Party Platforms; Availability.

Certain Program features are delivered via third-party platforms (e.g., Facebook, GoHighLevel, Zoom). Your use of those platforms is subject to their terms and privacy policies. The Company is not responsible for outages, feature changes, or data loss attributable to third parties, the internet, or force-majeure events. The Program and Sites are provided on an “as is” and “as available” basis without warranty.

Marketing and Media Release

By participating in the Program, you grant the Company the right to use your name, likeness, and any content you voluntarily submit in connection with the Program for promotional and marketing purposes. Use of your full name will require your written or email consent.

Payments, Auto-Renew, Cancellations, and Chargebacks.

You authorize the Company to charge the payment method on file for all fees shown at checkout. Unless otherwise stated in writing, subscriptions auto-renew every twenty-eight (28) days until cancelled. You may cancel at any time, and your cancellation will take effect at the end of the then-current billing cycle; no refunds or prorations are offered for partial cycles. If a payment fails, you authorize the Company to retry charges and to suspend or terminate access until amounts are paid. You are responsible for any taxes (sales, use, VAT, GST) and third-party processing fees. Chargebacks constitute a material breach: we may immediately revoke access and pursue collection of fees, chargeback costs, reasonable attorneys’ fees, and interest permitted by law.​

License & Use Restrictions

Use of the Program is licensed to the Client. No sublicensing is permitted. The license grants access to the Alumni Program, including webinars and group access. You agree to maintain the goodwill of the Program and follow all laws and Company guidelines.

​

The license does not grant ownership of any intellectual property. Misuse or misrepresentation of rights will be subject to legal action. Only one copy of the Program Material may be used unless otherwise licensed. Redistribution or reverse engineering is prohibited.

​​Dispute Resolution & Legal Agreements 

Disputes will be resolved via binding arbitration under Colorado law. Class action waivers apply.

Collaborative Agreement

This agreement outlines the commitments expected from both parties to ensure a results-driven experience. Listing BEAST is about creating a long-term, impactful, listing-focused business that delivers financial freedom and market domination.

Limitation of Liability

No guarantees are made on financial outcomes. The Company is not responsible for any damages, and success depends on your efforts and external market conditions. The Client agrees to hold the Company, its officers, affiliates, employees, and representatives harmless from any claims, liabilities, or damages arising from their use of the Program materials or strategies. Program content is for educational purposes only and does not constitute legal, tax, accounting, or financial advice. You should consult your own advisors before implementing strategies.

Termination & Revocation of Access

The Company reserves the unilateral right to terminate the Client’s access to the Program under any of the following conditions, with no refund, if there is a:

• Violation of the Program’s confidentiality, intellectual property, or payment terms.

• Misuse or abuse of Program resources or materials.

• Failure to comply with the conduct guidelines outlined will result in immediate removal. Upon termination, the Client’s access to all Program materials, coaching calls, and community groups will be revoked immediately, and no refunds or credits will be issued.

Changes to the Terms

We may update these Terms from time to time. Material changes will be indicated by an updated “Effective Date” and reasonable notice via the Program or email. Your continued access or use after changes become effective constitutes acceptance of the updated Terms.

By enrolling in, accessing, or using the Program, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.

​​This website (the "Site") is owned and operated by The Listing Beast, LLC ("THE LISTING BEAST," "BRENDAN BARTIC COACHING," "we," or "us"). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, Refund Policy, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

However, you may download or print a single copy of select materials for personal use, provided all copyright and proprietary notices remain intact.

SaaS Platform Access & Snapshot License (GHL-Based Services)
In addition to the Program, the Company provides access to a software platform built on GoHighLevel (“GHL”) infrastructure, including a custom Listing BEAST Snapshot (“Platform”). By using the Platform, you acknowledge and agree to the following:

1. You are granted a limited, non-exclusive, non-transferable license to access the Platform for your personal business use only.

2. You may not copy, share, resell, export, or reproduce any part of the Snapshot, templates, automations, workflows, or configurations.

3. Access to the Platform requires a valid subscription. If your subscription is cancelled, suspended, or terminated, all access to the Platform, automations, funnels, and data stored within will be revoked immediately.

Platform Dependencies & Uptime Disclaimer
The Platform is built on GoHighLevel (“GHL”) and may rely on additional third-party services such as AWS, Google, Zoom, and email/SMS providers. You acknowledge:

1. The Company does not control third-party outages, downtime, feature changes, or performance issues.

2. The Platform targets 99.9 percent uptime but cannot guarantee uninterrupted access.

3. The Company is not liable for losses, delays, missed communications, or business impacts caused by GHL downtime, third-party outages, or internet issues.

Data Ownership & Export Responsibilities
You retain ownership of all contacts, leads, messages, tags, pipelines, and customer information you enter into the Platform. You are responsible for exporting your data before cancellation.
Once your Platform access is cancelled or terminated:

- Your account becomes inaccessible.

- Data may be permanently deleted after 30 days.

The Company is not responsible for data retrieval after termination.

Automations, Workflows & Marketing Compliance
The Platform includes powerful marketing automations such as SMS, email, voicemail drops, pipelines, and triggers. You agree that:

You are solely responsible for ensuring all communication complies with TCPA, CAN-SPAM, CASL, state DNC registries, and all applicable laws.

You must obtain proper consent before sending marketing messages.

The Company may suspend or terminate your access for spam complaints, non-compliance, or abusive messaging practices.

You acknowledge that misconfigured automations can result in duplicate messages, incorrect sending, or unintended behavior. You accept full responsibility for reviewing, testing, and maintaining your automations.

Service-Level Agreement (SLA) & Security Measures
The Company maintains industry-standard security practices including encryption, multi-factor authentication (MFA), and restricted administrative access. Additional commitments include:

• Targeted uptime of 99.9 percent, excluding scheduled maintenance.

• Critical issues addressed within 4 business hours during standard business hours.

• In the event of a data breach caused by the Company’s systems, affected users will be notified within 72 hours in accordance with applicable laws.

This SLA does not apply to outages or incidents originating from GoHighLevel or any third-party provider.

SaaS-Specific Limitation of Liability
The Company is not liable for:

• User error, misconfiguration, or changes made inside your Platform account.

• Loss of leads, business opportunities, or revenue related to Platform usage.

• SMS, email, or automation errors triggered by user settings.

• Compliance violations arising from your messaging practices.

• Downtime or functionality issues stemming from GoHighLevel, AWS, or other integrated services.

Maximum liability for any Platform-related claim is limited to the subscription fees paid in the three (3) months preceding the event.

Prohibited Uses of the Platform
You may not:

Use the Platform to send spam, threats, abusive messages, or unlawful communications.

Harass or harm consumers through automated messaging.

Share access with unauthorized users or agencies.

Reverse-engineer, replicate, or resell Platform assets, snapshots, or configurations.

Circumvent Platform billing, subscription, or access controls.

Violation may result in immediate termination without refund.

​

Platform Termination
The Company may suspend or terminate your Platform access for:

• Non-payment or failed billing

• Abuse of the Platform

• Compliance violations

• Illegal or harmful activity

• Misuse of templates, snapshots, or proprietary systems
 

Upon termination, all access to the Platform, automations, and data is revoked immediately. No refunds will be issued for terminated accounts.

Platform Cancellation, Pause & Reactivation Policy

• Monthly SaaS subscriptions may be cancelled at any time and remain active until the end of the current billing cycle.

• Subscriptions cannot be paused.

• Previously configured automations and funnels may not be restorable after cancellation.
